The United States Citizenship and Immigration Services (USCIS) recently issued a new Form I-9. As you may know, the previous version expired some time ago. Employers must begin using the new form and instructions by May 7, 2013, at which point no prior versions of Form I-9 may be used. Employers who fail to use the new documents may be subject to penalties, enforced by Immigration and Customs Enforcement (ICE) and the U.S. Department of Justice (DOJ).

Key revisions are outlined below:

1. The addition of data fields, including foreign passport information
(if applicable) and telephone and e-mail addresses.

2. Improvements to the form’s instructions.

3. Revisions to the layout of the form, expanding it from one to two pages
(not including instructions and the List of Acceptable Documents). The
employee now completes the first page and the employer completes the
second page.

Who is subject to using Form I-9?
All employers must complete and retain a Form I-9 for every person they hire for employment on or after Nov. 6, 1986, in the United States, as long as the person works for pay or other type of compensation.
